Sedona's Tools Empowering People (STEP)

STEP Tool Library Rules and                         Regulations

1. Residents and those employed in the Sedona AZ area over the age of 18 with are eligible to borrow tools from Sedona Tools Empowering People (STEP) through the myTurn lending platform https://STEP.myturn.com
2. Borrowers must register with myTurn prior to borrowing tools. 
3. All tools and equipment lent by STEP are the property of STEP. Only the borrower is authorized to use the tool, and shall not permit any other person to use the borrowed item. 
4. Borrower agrees that STEP is not responsible for any manufacturing defects in the quality of workmanship inherent in any borrowed tool.
5. The borrower agrees that if the borrowed tool becomes unsafe or in a state of disrepair, the borrower will immediately discontinue use of the tool and return it to STEP.
6. Before borrowing any tool, the borrower will sign a Waiver and Indemnification form provided by STEP. This form will be kept at the STEP facility. The borrower acknowledges that he/she/they are capable of using the tool in a safe and proper manner, and that instruction in the proper use the tool is provided from STEP volunteers. 
7. The loan period for all tools is seven days. The borrower agrees to return any borrowed item on or before the due and in the same condition as when it was borrowed. The borrower agrees to pay for the loss or damage to any tool on loan to him/her/them at the time of returning or no other loans will be allowed until this debt is cleared.Repeated failure to return tools may result in revocation of borrowing privileges. STEP reserves the right to limit the number of tools borrowed and to alter the maximum loan period. 
8. If the borrower wishes to renew the loan, this will be done if there is no waiting list for the tool for an an additional loan period not to exceed 2 consecutive renewals of 7 days each. STEP reserves the right to deny renewal of a tool in high demand.
9. Reservations for tools can be made through the myTurn tool application platform. If the borrower reserves a tool and then does not come to pick it up, STEP may lend it to another borrower. STEP reserves the right to alter or suspend its reservation policies. 
10. When tools are not returned on the due date, a late notice will be sent to borrower in the form of an email, text and/or phone call to reestablish the STEP/Borrower trust relationship. 
11. STEP tools are loaned to individuals for home use and are not to be used in for profit ventures.
12. STEP reserves the right to refuse the loan of any item for failure to comply with the above rules or for falsification of any information. STEP may revoke lending privileges entirely for specified time period for patrons with repeat violations of these rules.

Tool Lending Library   

 The STEP Tool Lending Library is maintained and offered by NAZCCA and the Sedona Library for the use of Sedona residents registered through the myTurn.com STEP platform ages 18 and over.   

I, ________________________________ (print name), state that I have received instructions and am capable of using the tools/equipment I am borrowing, and that I will use the tools/equipment I am borrowing in a proper manner. 

 I, ________________________________ (print name), do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against the Sedona Library and NAZCCA (STEP), its officers, agents, and employees for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the STEP Tool Lending Library.  

 I, ________________________________ (print name), hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless the Sedona Library and NAZCCA (STEP), its officers, agents, and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the STEP Tool  Lending Library. I am aware that the Sedona Library and NAZCCA, its partners, directors, officers, members, and employees claim no expertise and make no representation concerning the appropriateness  of any tool for any particular use.  I affirm that the above information is current, true and correct and may be subject to verification. I further state that I have read and fully understand the borrowing rules and regulations of the STEP Tool lending Library, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.

I have read and signed this Waiver and Indemnification form, relinquishing any and all claims against the Sedona Library and NAZCCA (STEP), its officers, agents, and employees.
